Consignor's Representation: The consignor is the true owner of each consigned item and each item is free and clear of all liens, encumbrances, or claims by any other persons. 2. Consignor's Risk of Loss: the consignor is responsible for loss or damage to any consigned item until which time it is sold. Therefore, the consignors should maintain insurance against loss and damage. 3. Purchaser's Risk of Loss: Ownership of each item is immediately transferred to the purchaser at the moment the auctioneer announces "sold". Thereafter, the purchaser is responsible for purchased item/items against loss or damage. 4. Price Protection: It shall be the responsibility of the Consignor to protect the price of any consigned item; if it is necessary to do so. A $25 no sale fee for each item not sold in the auction shall be charged and due from the consignor prior to removing any items from the sale site. 5. Titled Consignments: No vehicle that requires a title will be sold unless the title is in the possession of the auction company prior to the auction. Buyers of a titled vehicle will be required to pay title, license & doc fees at the title company of their choice. 6. Consignor’s Payment: Commission expense will be deducted from the sale price of each item and the balance due the consignor will be mailed within a maximum of two weeks from the date of the auction. 7. Removal of Items: Each auction item, sold or not sold, must be removed from the sale site within two days of the auction. If not removed, the item/items shall become the property of Forrestville School District.
